BEN LAWSON TOOK THE STAND AFTER 10:30am, AND RECOUNTED THE EVENTS FROM JULY 12th & 13th OF 2008. LAWSON ALSO STATED NO OFFICERS WERE PRESENT WHEN THE STORY WAS MADE UP BY THE BOYS ABOUT THE EVENTS OF THE FIGHT. COLIN WALSH WAS RECALLED BY PROSECUTION, AND WAS GRILLED BY BOTH SIDES AS TO WHETHER OR NOT AN ERROR WAS MADE IN A STATEMENT REPORTED BY THE FBI. TESTIMONY CONTINUED TUESDAY MORNING IN THE FEDERAL TRIAL INVOLVING THREE FORMER SHENANDOAH POLICE OFFICERS. COURT WAS DELAYED UNTIL AFTER 11AM, DUE TO WINTER WEATHER CONDITIONS. NEY WAS WITH A MAN HE REFERRED TO AS MEXICAN JESSE, WHO WAS CARRYING THE BB GUN MISTAKEN FOR A REAL FIREARM. NEY ALSO TESTIFIED TO BEING IN THE POLICE CAR WITH PIEKARSKY WHILE THE OTHER BOYS SPOKE WITH THE OFFICERS OUTSIDE OF DONCHAKS HOME. SHENANDOAH BORO MANAGER, JOSEPH PALUBINSKY, TOOK THE STAND LATER TUESDAY STATING THAT MOYER AGREED CONTACTING THE DISTRICT ATTORNEYS OFFICE OR STATE POLICE WOULD BE A GOOD IDEA TO AVOID A CONFLICT OF INTEREST DURING THE INVESTIGATION. DURING CROSS-EXAMINATION, PALUBINSKY READ FROM A JULY 2008 NEWS ARTICLE, PROVIDED BY THE DEFENSE, THAT STATED HE DID NOT BELIEVE THIS WAS A RACIALLY MOTIVATED CRIME, AND CONFIRMED HE STILL HOLDS THAT STANCE TODAY. THE TRIAL IS SCHEDULED TO CONTINUE THIS MORNING, AFTER 9:00, AT THE UNITED STATES COURTHOUSE IN WILKES-BARRE.
